1. General Provisions

1.1 Parties to the Agreement

These Terms of Service (the "Agreement") constitute a contract between:

You (the "User") — an individual using the Calma AI service
We (the "Service" or "Administration") — the owners and operators of the Calma AI platform

1.2 Acceptance of Terms

By registering for and using Calma AI, you confirm that:

You have read, understood, and agree to the terms of this Agreement
You are at least 18 years old, or have obtained consent from a legal guardian
You have full legal capacity to enter into this Agreement
You understand the nature of the service and its limitations

1.3 Changes to the Agreement

We reserve the right to modify the terms of this Agreement at any time. We will notify you of significant changes by email or through the service interface at least 30 days before the changes take effect. Continued use of the service after changes take effect constitutes your acceptance of the new terms.

2. Service Description

2.1 What is Calma AI

Calma AI is an informational and educational wellness platform that provides:

A personal health journal with record-keeping capabilities
An AI assistant for general wellness information
Tools for organizing and structuring health information
Assistance in preparing questions for healthcare professional consultations

2.2 What Calma AI is NOT

IMPORTANT: Our service is NOT:

❌ A medical device
❌ A telemedicine service
❌ A diagnostic system
❌ A treatment prescription system
❌ A replacement for consultation with a qualified healthcare professional
❌ An emergency medical service

2.3 Use of AI Technology

The service uses artificial intelligence (AI) technology from third-party AI providers to:

Analyze text information about health and wellness
Provide general educational information
Structure data

Important to understand:

AI can make mistakes and be inaccurate
AI may generate incorrect or outdated information
AI responses are not medical conclusions
AI does not replace professional medical evaluation

3. Registration and Account

3.1 Creating an Account

To use the service, you must:

Provide accurate contact information (email)
Create a secure password
Confirm your agreement with this Agreement
Confirm your agreement with the Privacy Policy
Provide explicit consent for processing health data
Acknowledge the Medical Disclaimer

3.2 Account Responsibility

You are fully responsible for:

Maintaining the confidentiality of your account credentials
All actions performed under your account
Immediately notifying us of any unauthorized access

3.3 Age Restrictions

Primary Access: The service is intended for individuals aged 18 and over.

Minor Profiles:

You may create profiles for children and dependents
By creating a profile for a minor, you confirm that you are their legal guardian
You bear full responsibility for minors' data
Minors cannot independently register for the service

4. User Rights and Obligations

4.1 Your Rights

You have the right to:

Use the service in accordance with this Agreement
Create an unlimited number of patient profiles
Enter, edit, and delete your data
Stop using the service at any time
Delete your account and all data

4.2 Your Obligations

You agree to:

Provide accurate and truthful information
Not use the service for illegal purposes
Not attempt to gain unauthorized access to the system
Not use the service for spam or malicious activities
Not transfer your account to third parties
Comply with personal data protection legislation

4.3 Prohibited Actions

You are prohibited from:

Impersonating another person
Uploading malicious code or viruses
Attempting to circumvent the service's security measures
Using automated means (bots) without our permission
Copying, modifying, or distributing service content
Using the service in ways that may disrupt its operation

5. Use of AI Consultations

5.1 Nature of AI Consultations

AI consultations in our service:

Provide only general wellness information
ARE NOT medical recommendations
DO NOT replace consultation with a healthcare professional
May contain inaccuracies or errors

5.2 AI Limitations

The AI assistant CANNOT and WILL NOT:

Make medical diagnoses
Prescribe treatment or medications
Interpret medical test results
Provide dosage recommendations
Replace professional medical care

5.3 Mandatory Recommendation

You MUST consult a qualified healthcare professional in the following cases:

Any concerning symptoms
Before starting or changing treatment
To interpret medical test results
If your health condition worsens
When new symptoms appear

5.4 Emergency Situations

⚠️ WARNING: Our service is NOT intended for emergency situations.

If you experience the following symptoms, immediately call emergency services (112/911 or your local emergency number) or go to the nearest hospital:

Chest pain or difficulty breathing
Severe bleeding
Loss of consciousness
Signs of stroke (speech impairment, limb weakness)
Severe injury
Suicidal thoughts

DO NOT use our service to obtain help in emergency cases.

6. Data and Privacy

6.1 Your Data

You retain all rights to data you enter into the service:

Text information about symptoms and health conditions
Records of healthcare provider visits
Text excerpts from medical documents (that you add yourself)

6.2 What We Store

We store:

✅ Only text information that you enter
✅ Your consultation history with AI
✅ Metadata (dates, recording times)

We DO NOT store:

❌ Original medical documents
❌ Images of test results (only extracted text, if you add it)
❌ Biometric data

6.3 Third-Party Data Transfer

AI Service Providers: To enable AI-powered health information responses, we transfer necessary information to third-party AI providers:

Text of your health questions
Relevant context from your health history (minimized)
WE DO NOT transfer: Your email address, your full name (if stored), exact dates, addresses

AI providers process data in accordance with their Privacy Policies and applicable data protection agreements.

Other Third Parties:

We DO NOT sell your data
We DO NOT transfer data to advertisers
We may transfer data only as required by law

7. Intellectual Property

7.1 Administration Rights

The service, including its design, code, logos, and content, is protected by intellectual property laws. All rights belong to the Administration.

7.2 Your Rights to Content

You retain all rights to information you enter into the service. By providing information, you grant us a limited license to:

Store your data
Process data to provide the service
Transfer data to third-party AI providers for AI processing

7.3 License to Use

We provide you with a limited, non-exclusive, non-transferable license to use the service for personal purposes.

8. Limitation of Liability

8.1 General Limitations

IMPORTANT: The service is provided "AS IS," without any warranties.

We DO NOT guarantee:

Accuracy of information provided by AI
Absence of errors or failures in service operation
Continuous service availability (technical maintenance is possible)
That the service meets your expectations

8.2 Medical Liability

We are NOT responsible for:

Any medical consequences related to the use of information from the service
Decisions made based on AI recommendations
Inaccuracies or errors in information provided by AI
Delay in receiving professional medical care due to service use

8.3 Technical Liability

To the maximum extent permitted by law, we are NOT responsible for:

Direct, indirect, or incidental damages
Data loss (we recommend making backups)
Technical failures or service unavailability
Actions of third parties (including third-party AI providers)

8.4 Maximum Liability

Our maximum liability to you is limited to the amount you paid us for using the service in the last 12 months, or $100 USD (whichever is greater).

9. Termination

9.1 Your Right to Terminate

You may at any time:

Stop using the service
Delete your account
Request deletion of all your data

9.2 Our Right to Terminate

We may suspend or terminate your access to the service in the following cases:

Violation of the terms of this Agreement
Suspicion of fraud or illegal activity
At the request of law or regulatory authorities
Technical necessity or security

9.3 Consequences of Termination

Upon termination:

Your access to the service will be immediately terminated
Your data will be deleted within 30 days (unless you request immediate deletion)
Some data may be retained in accordance with legislation

10. Dispute Resolution

10.1 Applicable Law

This Agreement is governed by the laws of the European Union and applicable national legislation.

10.2 Pre-litigation Settlement

Before going to court, the parties agree to attempt pre-litigation dispute resolution. To do this, send a claim to our email: legal@calma-ai.com

We undertake to respond to the claim within 30 days.

10.3 Legal Proceedings

If pre-litigation settlement is impossible, disputes shall be resolved in judicial authorities at the location of the Administration.

11. Additional Terms

11.1 Severability

If any provision of this Agreement is deemed invalid, the remaining provisions remain in force.

11.2 Waiver of Rights

Our failure to exercise any right under this Agreement does not constitute a waiver of that right in the future.

11.3 Entire Agreement

This Agreement, together with the Privacy Policy, constitutes the complete agreement between you and us regarding the use of the service.

13. Agreement Confirmation

By using the Calma AI service, you confirm that:

✅ You have read and understood this Agreement
✅ You agree to the terms of the Agreement

✅ You understand that the service does not replace medical care
✅ You agree to the use of AI technology
✅ You agree to data transfer to third-party AI providers
